EEOC sues Kaiser for disability discrimination

SAN DIEGO — Kaiser Permanente has been sued by the U.S Equal Employment Opportunity Commission, which says the health insurer illegally fired a mentally disabled worker in 2008.

The worker at Kaiser's San Diego Medical Center could have performed his job adequately, if Kaiser had accepted an offer of free training, the lawsuit said. It was filed Wednesday in U.S. District Court for the Southern District of California in San Diego.

The EEOC says Kaiser violated the Americans with Disabilities Act by failing to grant reasonable accommodation to the former employee, David Grandin. The lawsuit requests Grandin receive "appropriate" back pay with interest, be rehired, and get other undetermined compensation.

In a response, Kaiser denied it had done anything illegal in its treatment of Grandin.

"At Kaiser Permanente, we are deeply committed to a fair and equitable work place for all of our employees and comply with all requirements of the Americans with Disabilities Act," Kaiser said in a statement. "As this is a pending legal matter, we are currently limited in what facts we can share publicly at this time, including what accommodations may have been provided during this plaintiff’s tenure with us. However, we certainly disagree with the allegations of unlawful conduct that have been made in this matter."

Kaiser had employed Grandin as a food service worker. Grandin has hydrocephalus, which limits his ability to learn.

"Defendant Kaiser's management thought that he was slow in performing his duties and that he could not stock food supplies at stations throughout the hospital because he would get lost," the lawsuit stated.

After being told in July 2008 that he was not doing his job adequately, Grandin asked for more training, but Kaiser refused, according to the lawsuit.

Grandin had asked for a temporary job coach from a San Diego-based nonprofit, Toward Maximum Independence. The nonprofit would have trained Grandin at no cost to Kaiser, but Kaiser refused, the lawsuit stated. Grandin was fired in mid-Aug
